By engaging PALIYA ASSOCIATES for legal services, you acknowledge that:

  • You have the authority to engage our services on behalf of yourself or any organization you represent.

Note: Our website and any general information provided do not constitute legal advice. A formal attorney-client relationship is only established upon execution of a written engagement agreement.

3 Client Relationship

An attorney-client relationship with PALIYA ASSOCIATES is established only when:

  • A formal retainer agreement or engagement letter is signed by both parties.
  • We have completed a conflict-of-interest check and confirmed our ability to represent you.
  • Any applicable retainer fee has been paid as agreed.

Merely contacting us, submitting the online form, or receiving a free initial consultation does not automatically create an attorney-client relationship or impose any obligation on either party.

4 Fees & Payment

Our fee structure is transparent and agreed upon before any engagement begins:

  • Initial Consultation: We offer a free initial consultation to understand your legal needs.
  • Retainer Fees: Specific fees will be discussed and agreed in writing before representation begins.
  • Court Costs: Court filing fees, stamp duties, and other out-of-pocket expenses are charged separately.
  • Payment Terms: Invoices are due within 15 days of issuance unless otherwise agreed.
  • Refunds: Fees already earned through services rendered are non-refundable. Unearned portions of any advance will be returned.

5 Confidentiality

We are bound by strict professional confidentiality obligations under the Bar Council of India Rules and the Advocates Act, 1961. Specifically:

  • All communications, documents, and information shared with us in the course of legal representation are strictly confidential.
  • We will not disclose your information to third parties without your explicit written consent, except as required by law or court order.
  • This confidentiality obligation survives the termination of our engagement.

6 Disclaimer

PALIYA ASSOCIATES makes no guarantees regarding the outcome of any legal matter. Legal results depend on many factors including:

  • The specific facts and circumstances of each case.
  • Applicable laws and judicial interpretations at the time.
  • Evidence available and witness cooperation.
  • Decisions made by courts, tribunals, and regulatory bodies.

Any past case results mentioned on our website or in communications are provided for informational purposes only and do not guarantee similar outcomes in your matter.

7 Limitation of Liability

To the maximum extent permitted by applicable law, PALIYA ASSOCIATES shall not be liable for:

  • Indirect, incidental, or consequential damages arising from the use or inability to use our services.
  • Loss of profits, business opportunities, or goodwill.
  • Actions taken by you in reliance on general information provided on our website without formal engagement.
  • Third-party actions, court decisions, or regulatory actions beyond our control.

8 Termination of Engagement

Either party may terminate the attorney-client relationship:

  • By Client: You may terminate our services at any time by providing written notice. You remain responsible for fees earned up to the date of termination.
  • By PALIYA ASSOCIATES: We may withdraw from representation upon reasonable notice if there is a conflict of interest, non-payment of fees, client misconduct, or other valid grounds under Bar Council Rules.

Upon termination, we will take all reasonable steps to avoid prejudice to your interests, including providing you with your documents and files within a reasonable time.

9 Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India, specifically:

  • The Advocates Act, 1961
  • Bar Council of India Rules
  • The Indian Contract Act, 1872
  • Information Technology Act, 2000 (for digital communications)

Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Courts in Jabalpur, Madhya Pradesh, India.
